DAMIEN ECHOLS APPEAL INFORMATION
The Arkansas Supreme Court returned from summer break and began its new term September 7th. Some minor motions in Damiens's appeal were decided on the Court's first Thursday date. Back on April 13th, Damien's attorney's submitted a motion to File Corrected Argument, a Motion to Expand Record on Appeal, and a Motion to File an Enlarged Brief. All three motions were granted on April 20th. This explains the delay in final submission because the State's responsive Motion to File (its own) Expanded brief was not presented to the Court until August 31st and decided on September 7th. The Supreme Court granted the State's motion as well. It is likely that the State should be fully submitted within 30-60 days. The Supreme court hearing on the merits of the appeal should follow shortly thereafter, most likely in November or December. Of course, depending on how the defense chosses to approach the new evidence issues, any estimates in this regard are subject to change.
